An FBI agent who shot a fellow passenger onboard a Washington, DC, Metro train line in December was arrested on Tuesday for attempted murder, prosecutors announced. Eduardo Valdivia was indicted with second-degree attempted murder, first-degree assault, use of a firearm and reckless endangerment charges, Montgomery County Circuit Court records show.

Judge Joan Ryon ordered Valdivia to be released on personal bond, and he must turn over all his firearms and his passport. A plea was not entered.

Valdivia's attorney Robert Bonsib told CNN over the phone Tuesday that the charges in the indictment are "very unfortunate and ill founded."

Valdivia, 37 of Gaithersburg, Maryland, was on his way to work when he allegedly got into a verbal exchange with Steven Slaughter while on a Red Line train after 6 a.m. on December 15, when shots were fired.

Investigators with the Metro Transit Police said in a statement on December 18 that video footage of the incident shows an adult male approaching Valdivia as the Metrorail car neared Medical Center Station in Bethesda. Words were exchanged, when Valdivia discharged his weapon several times, the Metro Transit Police said.

Slaughter asked Valdivia for money and when Valdivia said that he didn't have any, Slaughter walked away spewing expletives, prosecutors said in court on Tuesday. Valdivia, who was promoted last year to a supervisory special agent, told Slaughter to watch his mouth. The FBI agent's response caused Slaughter to turn back around and get into Valdivia's face before two shots were fired, prosecutors said.

It rather sounds like the judge agrees with that — but even a judge doesn't have the authority to stop a freight train in court if the prosecutor wants a guilty verdict.

Curious. When Blacks object to an arrest they are told to bring it out in court. When Cops are arrested it is a freight train that can’t be stopped towards conviction.

I used to take the red line for the short hop between judiciary and metro center to switch to/from the orange line. It was a different world on that line than it was on the orange or yellow lines. I had the cops basically throw me across the platform once as they were tackling some dude who was right up behind me when they caught up with him. There were at least 6 piling on him. He was a suspect in some shooting as best as I could tell later from the new reports of the arrest. All kinds of crazy used to happen in Metro Center. Saw several people getting their arrest on there.

When Blacks object to an arrest of course they are finding fault with the cop's conduct — if a cop is arrested it all depends on the extent to which the local brother cops and prosecutors are going to back him up or turn against him in court — this is an FBI agent we're talking about, not a normal cop, and the bosses at City Hall who do the hiring for the local police department hate the FBI probably more than they hate black people, and they might just as soon order a hit on an FBI agent whenever they think they could get away with it.

So the FBI is the good guys and the Local Cops are the bad guys?

Not always. Look both ways before you cross the street and all that, but if you're Black, you get all that civil rights stuff with the Feds you don't have with the local cops.

I would disagree with that. We know from the IG report on the FISA warrants that the agents lied on every single request. Not just the ones dealing with Trump and associates. But all of the ones examined from several offices. We know the FBI getting caught in a lie is what had the Bundy charges dismissed. We know the FBI lies regularly in court. The junk science of Lead Matching as one example.

So claiming you get a more fair deal if you are Black is unsupported.

But I will say this

washington dc has very strict laws againt carrying a gun for self protection

Now we have a member of the Deep State who can affirm the need for honest citizens to have guns to protect themselves
