If a Supreme Court justice - or a senator, or a congressman - tries to stow illegal aliens away so ICE agents cannot legally arrest him, he has committed obstruction, and should be arrested, charged, and tried.

It was a set-up question, where they knew the answer, so they could then run with it.
 
Funny, back when Clinton and Reno fought to send Elian Gonzalez back to Cuba, they fought against an asylum hearing, and the 11th Circuit said it is up to INS to make immigration policy and not the courts.

Saying, in part:


The judges acknowledged that Cuba violates human rights and the rule of law. But they said the INS, not the courts, should determine immigration policy.
