Let's hope the jury practices jury nullification and lets this dad go even if he is guilty. Drunk drivers are coddled way too much in america and as a consequence citizens are forced to be vigilantees to obtain justice.

HOUSTON (AP) — A Texas man whose two young sons were killed in a traffic accident has been charged with murder in the fatal shooting at the crash scene of a suspected drunken driver.

Brothers David Jr. and Caleb Barajas were helping their father push their broken-down pickup truck when a vehicle driven by 20-year-old Jose Banda plowed into them. The December accident happened just 50 yards away from the Barajas' rural Houston-area home.

Banda was later found shot. Brazoria County sheriff's investigator Dominick Sanders says witnesses saw David Barajas Sr. next to Banda's vehicle when shots were fired.

Barajas has been indicted for murder and was being held Monday in the Brazoria County Jail on a $450,000 bond.

Obozo would save a lot more lives by going after drunk drivers instead of gun owners. But he won't do that since his own dad was a serial DUI who once killed a man!!!

So, he shot this guy after either a breathalizer or a field sobriety test and knew for a FACT he was drunk and that was what caused the accident?

I suspect that very few drunk drivers who kill two children are coddled and escape justice, so I don't agree with your claim that citizens are forced to do anything to obtain it.

Whoever shot the driver should be sent to prison for manslaughter.

they don't need to nullify anything.

they just need to make appropriate findings of fact.

but you can't go be a vigiante.
 
If I had been the father of them boys, I wouldn't have killed the guy that ran them over, because killing is wrong and of course no one can get away with it unless it is self defense, but to make sure that the guy that ran them over did not get away with it, I would have made sure that the guy was left with physical damage that he would have to deal with for the rest of his life since the father of them boys is going to have to live with the guy's choice of action for the rest of his life.

The father witnessed jose kill his two sons . I doubt if he cares whether jose was drunk or not. He knows jose was at fault and isn't interested in your "call it an accident and forget it " crapola.

So, judge, jury and executioner is ok.

What a silly thing to say. The law lets people get away with lots of killing for reasons other than self defense. Happens all the time with highway homicide. Former FL laura bush once blew a stop sign and killed a guy and the law called it an accident and did nothing.

If there are family members of the slain driver, perhaps they will avenge the death of their loved one as well and kill the gunman.

HAHAHA. Fat chance. What we laughingly call the law would have let him plead to reckless driving and he'd have paid a fine and that's that. Most fatal crashes caused by drunk drivers or speeders or red light runners end up that way. Or maybe nothing at all would be done as happened with former FL laura bush.!!!

Source? What percentage of drunk drivers that cause fatal crashes just get a fine?

Or maybe you just talking out of your ass?
