...Guantanamo Bay is a facility to house POW's and quasi-POW's, who have been apprehended in the context of...for lack of a better expression...the "war on terror."
They are not held because of what they have DONE, but rather for what they ARE, that is, avowed enemies of the United States who have sworn to fight against Americans and US interests. They are at GITMO because they are not criminals and are not entitled to U.S. "constitutional rights." In fact, it would generally not be possible to "convict" these individuals in an American criminal court for a number of reasons. Not the least of which is that they may not have committed any "crimes" that are cognizable under U.S. criminal laws.
This latest terrorist is a CRIMINAL, who is being held because of what he is accused of doing. Like it or not, he is entitled to the full panoply of U.S. Constitutional rights, from the right of counsel, the right NOT to be subject to cruel & unusual punishments, the right not to be required to incriminate himself, and so on.
Trump is wrong on this one thing.
