Judge says US government didn’t follow court order on deportations


In an emergency hearing he called to address reports that immigrants had been sent to South Sudan, Judge Brian E. Murphy in Boston said the eight migrants aboard the plane were not given a meaningful opportunity to object that the deportation could put them in danger. Minutes before the hearing, administration officials accused “activist judges” of advocating the release of dangerous criminals.

“The department actions in this case are unquestionably in violation of this court’s order,” Murphy said Wednesday, arguing that the deportees didn’t have “meaningful opportunity” to object to being sent to South Sudan. The group was flown out of the United States just hours after getting notice, leaving them no chance to contact lawyers who could object in court.

This is a clear and deliberate violation of a lawful and unambiguous court order.

There must be consequences to maintain the rule of law.

The feds district court justices lack authority in this situation as the executive branch is not under the district court justices authority, as it's the other way around. If House speaker Gelatin Johnson would quit playing mister meek & mild & grow some balls he could push congress to defund the district court so called justices & we'd be rid of another politically saturated bureaucracy, @ quite a saving to the American taxpayer no less.

The pro-Democrat activist judges that are interfering in the deportation of migrants, seem to ignore that non-citizen migrants aren't processed through district courts, but instead, are given due process via the "immigration courts." Whatever the immigration courts decide is what is to happen to them.
The activist leftist pro-criminal judges would like nothing better than to get the migrants in their courtroom in order to set them free so that they can go back to creating more victims in the US.

And immigration courts operate under the authority of the Attorney General.

And they can be overruled by the Attorney General.

All those administrative immigration courts report to the Attorney General. Their job is to decide based on existing laws, not make up new ones. They can't order anyone to do anything, they don't have that authority. All they can do is implement existing law. Because they're executive branch, and the job of the executive branch is to administer and enforce existing law.
