In a Republic, actually
‘WASHINGTON (Reuters) - The U.S. Justice Department said on Thursday it was probing the release by an upstate New York sheriff's office of an immigrant living in the U.S. illegally, in what appears to be its first use of a new policy to target state and local agencies that do not comply with President Donald Trump's directives.

The department last week directed federal prosecutors to consider criminal investigations of state and local officials if they interfere with federal immigration enforcement, in a crackdown on "sanctuary cities."

The incident took place on Wednesday in Ithaca, New York, a deeply progressive city in New York's Finger Lakes region, and involved Mexican national Jesus Romero-Hernandez, 27, who had been in custody over an assault charge.

Federal prosecutors said the Tompkins County Sheriff's Office released him despite an outstanding federal arrest warrant on a charge of illegally reentering the U.S. after a prior removal.

Romero-Hernandez was later arrested on the immigration charge by federal agents.’

Justice can ‘probe’ all it wants.

What the County did was perfectly legal and constitutional.

There is no such thing as ‘sanctuary cities.’ State and local jurisdictions cannot be compelled to enforce Federal laws – including Federal immigration laws.

Of course Commie_Clayton supports woke “law enforcement” to release criminals and protect them from deportation.

Wow, your TDS brain has turned to mush jimbowhiner.

A lot of words to make a half-ass point but the OP is correct.

The feds can't compel a state/jurisdiction to hold a prisoner for the feds, it is done as a courtesy.

We've had all manner of fed agencies pick them up before.....ICE, Marshal Service, even the .mil branch MPs.

VDOC used to hold them for the feds for a limited time after their discharge dates.....Convicts were slated to leave at noon on their discharge day but we could hold them till midnight.

I can't recall a time when they did not pick them up within the time allotted, but they had to be removed from population and put in the intake building or an isolation cell after 1200.

This is true and I defend states rights, but they can be used inappropriately and have been superseded by federal law to enforce federal laws, like the school integration, drug use, abortion and any number of things. There is the letter of the law and there is the intent of the law, and the people must choose wisely and not let emotion do their thinking for them.

I don't think much of further eroding state's rights.

If blue/insane states want to hold on to their evil residents, then fine, they can be delt with after the saner states get shed of theirs as there is plenty of good work to be done in saner states.

There are clearly " sanctuary cities" where criminals are protected by leftist politco-religious ideology. State and local jurisdictions that aid and abet criminals are going to be held accountable.

Exactly right. If North Dystopia wants to go house to house and seize every gun and knife, have at it. If Merryland wants to issue glocks and switches to juveniles to support their bidness, get er done. Want to drive all the citizen taxpayers out of Aztecafornia and go with low wage immigrants who bring their own enforcement programs, good luck. Your people want this, give it to them. Just be aware that the rest of the country might cut you loose from the benefit bonanza that you are used to, and other states that you deal with might not be as understanding as you are.
