Trump had no failed memory though... He had several obstruction of justice incidences showing he had no memory failure or misunderstanding, he intentionally lied to authorities and intentionally tried to cover up his own crimes....

So his age and memory would not give a jury doubt....the obstruction is clear evidence, he understood what he did and was doing, was wrong.
