It most definitely was Donald Trump’s argument. Unless he has been convicted on impeachment, the president is immune from prosecution for any crime he commits while in office. According to trump, he can only be criminally charged if he is first impeached and convicted in the Senate.

Of course, when he was impeached the second time, he said that he shouldn’t be impeached because he was no longer president and he should be criminally charged instead.
