ACLU asks judge to force the Trump administration to state under oath if it violated his court order

Anyone that's being prosecuted for a crime and is facing prison time, yes. Illegal aliens aren't going to prison. They're being sent home. They have no right to come to The United States.
Yes you said that. Now cite the law that supports you. Given we have hundreds of immigration judges, the magic eight ball says you are mistaken.

Due process only applies when someone is being deprived of life, liberty and property. Illegal aliens aren't being imprisoned, they're being sent home.

T he prisoners in question are Venezuelan in US custody being transported to a commercial prison in El Salvador fire detention.

Sounds like deprivation of liberty to be.

Those judges are not Article III judges, and they can be dismissed by the AG at any time.

You missed the point my dear, the law says that one must have due process in the USA,

Yes, the U.S. Constitution guarantees that no one can be deprived of life, liberty, or property without due process of law, as stated in both the Fifth Amendment (regarding the federal government) and the Fourteenth Amendment (regarding state governments).

Here's a more detailed explanation:
  • Due Process Clause:
The Fifth and Fourteenth Amendments contain a "Due Process Clause" that states, "nor shall any person... be deprived of life, liberty, or property, without due process of law".

  • Federal vs. State:
The Fifth Amendment applies to the federal government, while the Fourteenth Amendment applies to the states.

  • Procedural Due Process:
This aspect of due process ensures that government actions that could deprive someone of life, liberty, or property must be carried out fairly and according to established procedures.

  • Substantive Due Process:
This aspect protects certain fundamental rights from government interference, even if fair procedures are followed.
    • Right to be heard: Individuals have the right to present their case and be heard before being deprived of life, liberty, or property.

    • Notice of charges: Individuals must be informed of the charges against them.

    • Right to counsel: Individuals have the right to legal representation.

    • Right to a fair trial: Individuals have the right to a fair and impartial trial.
  • Importance of Due Process:
Due process is a cornerstone of the American legal system, ensuring that the government acts fairly and justly.
Due process died when Trump rode down the escalator in 2015, and it was Democrats who spent the next 10 years making sure it stayed dead.

"Plaintiffs in a lawsuit filed to halt deportations under a rarely-used 18th century wartime law invoked by President Donald Trump asked a federal judge Monday to force officials to explain under oath whether they violated his court order by removing more than 200 people from the country after it was issued and celebrating it on social media.

The motion marks another escalation in the battle over Trump’s aggressive opening moves in his second term, several of which have been temporarily halted by judges. Trump’s allies have raged over the holds and suggested he does not have to obey them, and some plaintiffs have said it appears the administration is flouting court orders.

On Saturday night, District Judge James E. Boasberg ordered the administration not to deport anyone in its custody over the newly-invoked Alien Enemies Act, which has only been used three times before in U.S. history, all during congressionally-declared wars. Trump issued a proclamation that the 1798 law was newly in effect due to what he claimed was an invasion by the Venezuelan gang, Tren de Aragua.

Trump’s invocation of the act could allow him to deport any noncitizen he says is associated with the gang, without offering proof or even publicly identifying them. The plaintiffs filed their suit on behalf of several Venezuelans in U.S. custody who feared they’d be falsely accused of being Tren de Aragua members and improperly removed from the country.'

Go Trump. Fuck those thugs.

Your sympathy for pigfucker terrorists that beat and decapitate people for sport is pathetic.

Tell the judge to step up and have these migrants move next door to him. They already broke the law in the manner they entered this Nation and then proceeded to create terror.

What the fuck is the matter with you people??

Immigration judges handle legal immigration cases. Illegal aliens don't get to go before an immigration judge because the judge cannot allow them to remain in The United States legally.

The fact that hearings are utilized by the Executive to secure an informed basis for the exercise of summary power does not argue the right of courts to retry such hearings, nor bespeak denial of due process to withhold such power from the courts. ~ Page 335 U. S. 172
