The Whopper has been around since 1957, and now, nearly seven decades later, Burger King will have to defend arguably its most popular sandwich in federal court.

U.S. District Judge Roy K. Altman in Florida, on May 5, denied Burger King's motion to dismiss a 2022 lawsuit alleging the fast food chain misled customers by falsely advertising the Whopper and other menu items in commercials and various in-store and online promotional material.


The 19 people suing Burger King argue that the fast food chain “advertises its burgers as large burgers compared to competitors" by showing them "containing oversized meat patties and ingredients that overflow over the bun to make it appear that the burgers are approximately 35% larger in size, and contain more than double the meat, than the actual burger," according to the lawsuit obtained by USA TODAY.

I worked at a Jack-in-the-Box for almost 4 years. Met my wife of 51 years working their together. We did our best to cook them and put them together the best we could. Back then, it was speed, not carefully putting them together. This suit is stupid and a waste of tax payer's money. People need to be responsible for quacky lawsuits and pay us, the shareholders, when they lose these stupid cases. Maybe there would be far less of these and less lawyers too!

People are just trying to 'have it their way' at Burger King, right?
 
I think it's hard to prove a false advertising case. And even though I personally also think actual burgers don't look as good as the advertised burgers, nevertheless this isn't proof of anything. Maybe they simply picked the best picture to use in their commercials. This can be argued as "false advertisement" or "misleading", but then it falls upon the accuser to prove it. The burger joint doesn't need to prove anything.

Most likely, I think it's just some schmuck hoping to get rich quick.

19 people from 13 different states...class-action suit has been going on since 2022.

Aside from recouping monies earned from Burger King's alleged false advertising, the customers are ordering Burger King to "stop selling Overstated Menu Items or to correct the deceptive behavior," the lawsuit says.

This suit is stupid and a waste of tax payer's money.

The thing is that all companies take advantage of advertising stuff to look better than the actual product. It is common practice to hire companies who do nothing but arrange food down to the smallest detail to make you hungry for it.

NOTHING anyone sells ever looks as good as what the pictures show.

If a burger place took an actual burger they sell off the assembly line and used that for their ads, no one would want to order it. That is why they always have you pay first before getting your food.

What is stupid about this suit is their suing Burger King for a practice that all fast food places do.

What we really need is actual honesty in advertising.
 
Brave consumers . Admitting they have ever been into such an establisment . Degrading .

The only time I have ever been into a Mc Donalds was one opposite the main railway station in Kyiv .
We bought nothing but appreciated the advice that it had the best toilets ever .
That was true .

Note for reference--- for after we get back Kyiv for proper governance .
