You have to believe that Musk and his army of lawyers declared to him that this was not illegal. At worst, they would have said it was a grey area and he could decide to pursue it or not.

Not even Gov Shapiro stated it was illegal when asked I don't believe. I think even Mark Cuban said it was legal from those who advised him, but he simply said, as a Harris supporter that this showed that Musk and Trump were desperate.

If it is not legal, the judge assigned, will give the suit no standing or no merit, and the case will be dropped.
