Judge blocks Trump bid to halt federal funding for sanctuary cities

‘A federal judge in California issued an injunction Thursday blocking President Donald Trump's efforts to halt federal funds from going to several cities and counties considered sanctuary jurisdictions.

“The challenged sections in the 2025 Executive Orders and the Bondi Directive that order executive agencies to withhold, freeze, or condition federal funding apportioned to localities by Congress, violate the Constitution’s separation of powers principles and the Spending Clause,” U.S. District Judge William Orrick said in his ruling.

“They also violate the Fifth Amendment to the extent they are unconstitutionally vague and violate due process,” while Trump's orders "violate the Tenth Amendment because they impose coercive condition intended to commandeer local officials into enforcing federal immigration practices and law."’

There’s no such thing as a ‘sanctuary’ city.

State and local jurisdictions cannot be compelled to enforce Federal law – including immigration law.

It is perfectly lawful and Constitutional for local jurisdictions to elect to not use limited resources to detain undocumented immigrants.

But sanctuary cities are violation of the law as well:


So how do they comport with allowing cities to break the law?

The issue is when the illegals are let out, especially gang-bangers, and they kill someone, that could have been avoided. There should be more concern for citizens and less concern for illegals, but please keep that 80/20 issue for 2026.
The families of these victims should sue the law enforcement, and the sanctuary city, county, state that approved their release with the knowledge that they were in violation of federal laws. Money is all these morons seem to understand.
 
The federal govt can not force the local governments (through threat of withholding federal funds in this case) to do their own federal job of handling U.S. immigration....at least not without paying them to assist them....basically....because local and state paid taxes are needed and spent by their own legislature for their own citizens and tax payers, from my understanding of it...

But the federal government can charge and convict these city leaders for violation federal immigration laws.

I agree that gang bangers that are going to kill someone should be held by local police until ICE can get there....but they need to be reimbursed for doing the Fed's job....

Btw, they don't just decide to release from jail if in jail, A Judge makes that decision based on their state laws on crimes allegedly committed....I believe?

(A) Any person who—
(iii)
knowing or in reckless disregard of the fact that an alien has come to, entered, or remains in the United States in violation of law, conceals, harbors, or shields from detection, or attempts to conceal, harbor, or shield from detection, such alien in any place, including any building or any means of transportation;
(iv)
encourages or induces an alien to come to, enter, or reside in the United States, knowing or in reckless disregard of the fact that such coming to, entry, or residence is or will be in violation of law; or

(v)
(I)
engages in any conspiracy to commit any of the preceding acts, or
(II)
aids or abets the commission of any of the preceding acts,

shall be punished as provided in subparagraph (B).

(ii)
in the case of a violation of subparagraph (A)(ii), (iii), (iv), or (v)(II), be fined under title 18, imprisoned not more than 5 years, or both;

(iii)
in the case of a violation of subparagraph (A)(i), (ii), (iii), (iv), or (v) during and in relation to which the person causes serious bodily injury (as defined in section 1365 of title 18) to, or places in jeopardy the life of, any person, be fined under title 18, imprisoned not more than 20 years, or both; and

(iv)
in the case of a violation of subparagraph (A)(i), (ii), (iii), (iv), or (v) resulting in the death of any person, be punished by death or imprisoned for any term of years or for life, fined under title 18, or both.

These penalties are for EACH ALIEN they harbor:

(B) A person who violates subparagraph (A) shall, for each alien in respect to whom such a violation occurs—

How many aliens are these sanctuary cities harboring? THOUSANDS?

That lady judge in WI snuck the illegal out the back as the state prosecutor and victims were there to testify against him.
It doesn't cost anything to pick up the phone and call ICE.
That judge went outside to yell at ICE and told them to see the head judge before sneaking out with the illegal.
 
This is a direct effect of the sitting president being presented with a pork barrel massive spending bill that is delayed until it is a "must pass" financial emergency, and the line item veto has already been removed from play. The solution is for the voters themselves to become an active ingredient in this instead of being a willing participant in order to get more financial gain from the proceedings. Not likely to happen, as our media portrays this as the way it's always been done. The only way that Congress comes up with these ridiculous appropriations is to work together to squeeze as much tax money out of the people that they can to redistribute it to be re elected and honor their campaign promises to their benefactors.

They way it worked under democrats is by "continuing resolution", CR, meaning no appropriations Bills get passed.
Republicans are vowing to pass Appropriations Bills, we'll see if that happens.
 
Has this law ever been used??? Millions of employers are using illegal aliens working for them....we should be hearing about hundreds of arrests and charges a day, of the employers....based on this law....


I have no idea if and when it's used...but the law is in the books, so it's viable.

As far as employers, I remember stories back in the 90s of Tyson Foods, where they would get raided by INS because of their practice of employing illegals. Granted, they don't get raided anymore...and they appear to employ illegals.
