The New York State Supreme Court reinstated all employees who were fired for not being vaccinated on Monday, ordering backpay and saying their rights had been violated.

The court found that "being vaccinated does not prevent an individual from contracting or transmitting COVID-19." New York City Mayor Eric Adams claimed earlier this year that his administration would not rehire employees who had been fired over their vaccination status.

NYC alone fired roughly 1,400 employees for being unvaccinated earlier this year after the city adopted a vaccine mandate under former Mayor Bill de Blasio.

This is stellar and it’s been my contention since day 1 that virtually ALL “Get shots or get fired” was unwarranted and illegal
Remember this fir those who embrace facts-It doesn’t stop you from getting it and it doesn’t stop you from transmitting it and it has no effect on the intensity of what you transmit to others. Why in the world then would your vital employment be threatened and held hostage to participating in the experimentation ?

Governments pushed millions of people worldwide to get vaccinated... The got perfectly healthy young people to take the jab using false arguments. The called the people who refused to comply "anti-social." Many governments introduced COVID passports. These passports made access to parts of society conditional. Those who did not wish to get vaccinated could not visit a restaurant or a gym, all in the name of public health.

This was real institutionalized discrimination.

Vaccine mandates were introduced for certain professions. Many people lost their job, their livelihood, their business, because they stood by their principles.

The government of some countries literally imprisoned people within their own homes.

All of this was based on the idea that vaccination helps prevent the spread of the virus.

This has now proven to be a big lie. There was no scientific basis to say that vaccination would stop the transmission of the virus, and it's one of the biggest scandals of our time.

One word of caution. In NY State, the Supreme Court isn’t supreme. It is a lower level trial court. Then comes the Appellate Division. Finally, the States top court is called The Court of Appeals.

I only mention this since the ruling from one Supreme Court Justice in one county is obviously subject to the prospect of an appeal.

Specifics of the ruling...

“Based upon the Petitioners’ vague denials of their exemptions, the fact they were kept at full duty for several months while their exemptions were pending, the Mayor’s Executive Order granting exemptions to certain classes of people, and the lifting of the private sector mandate, this Court finds the Commissioners Orders of October 20, 2021, and December 13, 2021, as well as the Mayor’s Executive Order No. 62 to be arbitrary and capricious.”

Backpay must be issued to the fired employees in both the private and public sector.

The court also found Adams and other NYC agencies presented no scientific basis for imposing vaccine mandates on public employees while providing exemptions for certain private professions...

“There is nothing in the record to support the rationality of keeping a vaccination mandate for public employees, while vacating the mandate for private sector employees or creating a carveout for certain professions, like athletes, artists, and performers.”

“This is clearly an arbitrary and capricious action because we are dealing with identical unvaccinated people being treated differently by the same administrative agency.”


The court also concluded the vaccine mandate was not in the interest of public health, but was meant to establish “compliance,” citing the vaccine’s inability to “prevent an individual from contracting or transmitting Covid-19” and government’s selective enforcement of the mandates...

“The vaccination mandate for City employees was not just about safety and public health; it was about compliance....if it was about safety and public health, unvaccinated workers would have been placed on leave the moment the order was issued. If it was about safety and public health, the Health Commissioner would have issued city-wide mandates for vaccination for all residents.”
