One small misstep in the termination process could have resulted in the company possibly suffering fines, extreme negative publicity, and being forced in the end to retain said employee anyway. Even if the company had lined everything up properly, there would have possibly still been an extended and costly legal battle. He'd have had his pick of lawyers ready to fight what would be deemed a "religious discrimination" case.

There was this one employee that was a total screw up - never could get paperwork right, rarely showing up on time, and got hostile any time constructive criticism was offered. We all complained to upper management but nothing was ever done. This employee got wind of what was happening, and started performing even worse than before, along with saying things like "I hope they try and fire me... I'll own the company if they do, so go ahead and do it." We got lucky... he eventually found another job.

If I remember correctly, he worked for G4S, a company with $200M+ of Gov't. contracts.
The company probably didn't want to risk losing them due to having a "religious discrimination" suit filed against them.

All they had to do was get the dude on tape following the laws set forth in the state for recording people. If he was as unstable as they say he was they would have gotten him easily.

In my State, only one party being recorded has to have knowledge of the recording and that can be the one doing the recording.
