If a lawsuit happens, it's more likely to be predicate on federal civil rights protections. Modern case law is pretty clear that actions based on citizenship automatically come pretty close to being inherent discrimination based on race and/or national origin.

My guess is that most corporations would not risk hiring illegal migrants as direct employees , rather the vast majority of illegal migrant employment is through independent contractors ( dba - migrant status ? ) who hire illegal migrants as needed and do not maintain them as direct employees .

More than 60% of all illegal migrants have an employee identification number and file tax returns , while the irs does not report such status to ice .

A major concern for myself is to apply the term " thereof " in us 14th amendment correctly , to stop illegal migrants from getting 18 years of social subsistence based on a citizenship status of a child whom should have been awarded jus sanguinis citizenship in the maternal country of origin , which will also alleviate the family separation issue and discourage a primary motivator and illegitimate entitlement of illegal migration .
