Zone1 The Doctrine of Disparate Impact

Basically, you're ignoring a very vital part of the equation. How many Caucasian students applied vs minority students that qualified for the set-aside seats? Let's illustrate with an extreme example. Are white students disparately impacted if there are 16 seats set aside for which they cannot compete and for which 16 students are applying vs 84 seats that are not set aside for anyone but for which 10,000 students are applying? If you are honest, you would acknowledge the importance of that piece that you left out.
No I'm not. You are trying to make excuses. Whites were given 84 seats based on the fact there are more of them. Whites had no right to all 100 seats.

Futhermore Bakke had been denied twice from entering that school because he did not meet the standards.

You're not being honest and acknowledging that, unless the number of set-asides for which Caucasians are not allowed to compete is carefully set, they would have to compete against a lot more students for the ones they were allowed to compete. You're also not being honest when you say that minorities were restricted to 16 seats. They were not, they were allowed to compete for all 100 seats while Caucasians were only allowed to compete for 84. Claiming they could only compete for 16 is admitting they could not compete on a level playing field.

Tell you what, find for me where the policy is set that those 84 seats are reserved only for Caucasians and have survived the onslaught of lawsuits.
