Secretary of State Marco Rubio and El Salvador President Nyibe Bukele both announced earlier today on X that a joint “counter-terrorism operation” had been carried out that resulted in the “transfer” of 17 dangerous gang members — of both Tren de Aragua (TdA) and MS-13 — from the United States to El Salvador.
This has happened while the Temporary Restraining Order imposed by Judge James Boasberg in the District Court for the District of Columbia remains in effect. That TRO prohibits the transfer to any location outside the country of alleged members of TdA who are covered by President Trump’s invocation of his power to remove “alien enemies” under the Alien Enemies Act of 1798 (AEA) — which he invoked by Proclamation on March 15, 2025.
If you have been following this story you know that later in the day on March 15, two planes with members of TdA and MS-13 departed for El Salvador as the ACLU was going into federal court in Washington D.C. to seek injunctions preventing such removals based on a claim that the invocation of the AEA was unlawful.
