You might want to read that again, it doesn't say what you are hoping it does.
The President as the quoted section refers to is the current occupant of the Oval Office which is Joe Biden.
What that text is saying is that when a President turns over records to the Archivist (NARA) at the end of their term before becoming the ex-President, that he can designate records as restricted for additional years. That part is contained in the PRA of 1978 beyond the normal 5 year limit.
So two things.
#1 If the Ex-President is allowed to keep their records, then why would 1270.44 say that those listed (the current President or Congress) have to request the records from the Archivist if the ex-President is the one that actually has the records? That isn't the case. 1270.44 assumes that the ex-President complied with the PRA of 1978 and turned over the Presidential Records as required by the law and that in addition the outgoing President notified the Archivist of records to have additional restricted access time.
#2 Trump isn't President. Under the PRA of 1978 he (or his designated representative) is allowed access to Presidential records through the NARA. That doesn't mean that he gets to have custody of Presidential Records. The records, under the PRA of 1978, are turned over to the Archivist and the NARA retains custody. The ex-President (or his designee) can view them at an NARA facility with prior arrangement.
