Couple Sues Wal-Mart for Calling Cops Over Bath Time Photos

My question would be, why would the case cost $75,000 in legal bills????

Obviously you've never had a lawyer...

I work at a Law firm, lol.

For a family court proceeding, a public defender should be fine.

The Judge simply had to look at the photos and order a psych evaluation for the family to determine innocence, which is what happened.

What kind of shyster lawyer would charge 75,000 Dollars for that?

Even the attorneys at my firm, who are ridiculously over-priced, mind you, wouldn't charge that.

I thought I read somewhere that this case was ongoing for a year or better...

And I sure as hell wouldn't rely on some public defender, either.

I don't care much for the case, even though I feel really bad for the parents for having their kids taken away on account of a few pictures and an over-zealous Wall-Mart employee. However, it raises a really good issue ... and that is of nudity and USA.

I have a question for y'all. Why is nudity in the USA considered so offensive? Is there really something wrong with nudity? When I was growing up in Europe, it was completely ordinary for little kids to be running around their homes and backyards but naked (during the warm months, of course). Even around public swimming pools and lakes (and beaches in countries with them) it was seen as absolutely normal for little kids to run around and play naked. It was not viewed as offensive by anyone. I think it is actually very healthy for children not to be ashamed of their bodies from the moment they are made aware of them. It builds healthy confidence and healthy relationship to their bodies, it teaches them that nudity is our natural state...

I genuinely have no idea.

Perhaps there's a bunch of REALLY insecure people in the US, that don't want prospective mates to see how they stack up?

Personally I'm comfortable with nudity. I'm not going to run around outside naked of course, as I'd be arrested...

Of course, there are limits to everything. :) It's about where one draws the line.

No, it's about being a fuckwit (to use Del's term) or not. The pics were taken at WalMart? If so, why did the walMart photographer take them? THEN blame the parents?

You can't cure stupid.

No Gunny...the pictures weren't taken AT Walmart they were taken TO Walmart to be developed. There were 8 photo's out of 144 that were taken during a vacation. 8 pictures out of 144 were of the kids playing around at bath time. ONLY 8 pictures out of 144 showed any kind of partial or total nudity of these kids.

This is a very difficult issue. On the one hand, Wal-Mart appears to have stepped over the line and initiated something that was horrific for the parents and kids involved. Yet on the other hand, legislatures pass laws with the good and honorable intent of doing what's necessary to protect innocent children from predators.

I think the real problem lies with the government rather than the store. The Wal-Mart employee was simply following policy. The common sense application should have occurred at the state agency and law enforcement level. Someone in government should have seen that these pictures did not constitute child pornography. It should never have gone beyond the state agency/law enforcement level.

Being falsely charged and having their kids taken away from them, I'm pretty sure they were going to get the best attorney possible. Once you realize that the state can do what they did, you are left to wonder if you might not actually end up behind bars for taking some pics of your kids.

I understand the great concern for the welfare of the kids, but the fact is that these people were assumed guilty until proven innocent, and that goes completely against the way our system is supposed to work.

Most people in the US are very screwed up when it comes to their own sexuality. The only time you'll ever hear anyone discussing sexuality is when they are telling a dirty joke. It's a very different attitude from those in Europe. I'm not going to argue for one over the other, but Americans and Europeans views on sexuality are very different, and that includes how we raise our children.

Why would the exploitation of children even be a part of this discussion? No one has alleged these children were exploited, have they? In my opinion children are exploited everyday and I don't hear anyone complaining. Cases in point Jon and Kate's children, every child under the age of 17 in a beauty contest, these are children that's being exploited on a daily basis and I don't hear squat about it from the left.

*On a side note and off topic*

Are you pro-life or pro-choice?

My point was, there ARE people out there who exploit their own children. We've all read the stories. That is why they have these investigations. I'm not saying these parents did.

Not sure what my feelings on abortion have to do with anything. I'm pro-choice, but I don't think it should be used as a means of birth control. I believe it should be reserved for severe defects, the mother's life and health, rape/incest.

Why would it be ongoing for a year or better when CPS ruled in their favor and returned the children within a month?

Something fishy about all of this...

How ironic...

Fair enough, thanks for the clarification.

Do you believe the sperm donor should have any input in the abortion process? And why or why not?

Oh and it really didn't have anything to do with the current topic, I was just curous to see where you stood on the issue.

I'm a simple man. Honestly, a cold drink, a few ice cubes, some nice music and time to go through my recipe cards, is all I need. The nude pics don't do so much for me. I guess if Mr. Flew wanted that he'd simply go meet a nice girl, get to know her, and see if it leads to marriage. Been down the road once, didn't pan so well.

Potatoes Not Rotten Recipe

Peel two medium sized potatoes
cube them up
add butter,
put in pan in oven at least one inch deep (the pan) because the oil heats and burns otherwise.
add olive oil, take from bottle and pour some out, a little all spice to cover all the spices
bake for about 30 minutes, forget to stir and they stick.
