Florida Stand-Your-Ground Repeal Fails

The problem with SYG laws isn’t the law itself, it’s a perfectly appropriate doctrine consistent with the Constitutional right to self-defense.

The problem is too few gun owners understand what actually constitutes a SYG situation, local law enforcement agencies also lack understanding as to SYG with regard to investigating a self-defense claim, and prosecutors and judges lack sufficient precedent to know when to press charges and how to evaluate the evidence should a SYG case go to trial.

Last evening the Florida House conducted a public hearing, judiciary committee debate, and committee vote on HB-4003, which would have done away with Florida’s Stand-Your-Ground law by repealing Florida statute 776.013. Home protection; use of deadly force; presumption of fear of death or great bodily harm.

The outcome was that HB-4003 was soundly defeated in committee, thereby ending the effort to repeal Stand-Your-Ground in this year’s legislative session.

776.013 is a multi-part statute that contains not only the primary “Stand-Your-Ground” statute, but also presumptions of reasonable belief of fear of imminent death or grave bodily harm. Thus, if successful, HB-4003 would not only have repealed “Stand-Your-Ground” but also have made it more difficult for law-abiding armed citizens to defend themselves in home invasion, carjacking, and kidnapping scenarios.

HB-4003 was proposed by Rep. Williams, who is not a member of the judiciary committee and therefore not entitled himself to vote on the proposed bill in this setting.

After 8 years and 135 FATAL Stand Your Ground cases in Florida:

44 blacks were accused; 25% convicted; 55% justified ; and 9% pending..
76 whites were accused; 33% convicted; 53% justified; and 11% pending...

By repealing the law, all those blacks found "justified" would be convicted!
Do the idiots that want the law repealed that without the SYG law nearly 22 blacks would be in prison!

Tell me especially the BLACKS want more BLACKS convicted of killing because the "Stand Your Ground" law is repealed!

There's no reason what so ever that the victim should have to be punished. Stand your ground is a good law.

Oh, a postscript: The bullets fired, I think about 8 of them, entered the vehicle through the doors. Those kids hadn't even started to get out of their damn car.
It is impossible for you to show how this relates to, and negates the validity of, SYG laws.

None of that supports changing or repealing those laws though. If that is the real problem then the solution is time and education. Simple as that. As these laws age, the understanding of how they fit into the legal framework will be refined as all other laws do as well.
