My friend, you have no idea what I am. Just because I take a liberal stance on one issue does not necessarily mean I will take a liberal stance on another.

I honestly thought more people around here would appreciate someone who actually took positions on both sides of the political spectrum...

You're being too generous to them, you're not taking a "liberal" stance on this issue. You're taking a constitutional and principled stance... which is what conservatives USED TO be about. These days? It's more about partisanship, sadly.

As I've been saying on other threads... if we play fast and loose with doing things the legal and constitutional way with those we don't like... we're only shooting ourselves in the foot, because that precedent that is set will almost certainly come back to bite us in the arse. That's already happened, and will only get worse if things keep going this way.

I have said this of both sides.

The law is only convenient to you so long as it supports your point of view. In this case it doesn't.
 
I do want him gone, but damn, I want it done right! Same for the rest of them. Batch try them under Title 8 if you need to, but give them due process and get rid of them to wherever they came from!

In this case, the authority violated an order. Thus it invalidates the charge of illegal entry. It has to be retried. No ifs, ands, or buts.
Usually, a judge would not order a mistrial for prosecutorial misconduct. It would be a directed verdict of not guilty.

As for this case, the violation of the order could be seen as prosecutorial misconduct (or incompetence). Either way it made due process impossible because the order was violated. The order can no longer be carried out, and the matter of his illegal entry must be tried again.
