I heard an interesting interview with the head of the ACLU yesterday.

The flaw in that NPR report and in your post is that I have never heard Trump say he was going to use the alien invasion act to deport illegal aliens.

Joe Biden has been deporting illegal aliens for the last 3 1/2 years without invoking that act. Barack Obama bragged about deporting more illegal aliens than his predecessor George Bush the younger.

Where did you get the idea that Trump needed? The alien invasion act to stop illegal immigrants from making a permanent home in the country in which they are trespassing?

I have never heard Trump say he was going to use the alien invasion act to deport illegal aliens.
Problem solved.

Former President Trump used a campaign stop in Aurora, Colorado, on Friday to detail a plan to target undocumented immigrants with gang ties.
The big picture: Trump said he intends to invoke the Alien Enemies Act of 1798 if elected to target "every illegal migrant criminal network operating on American soil." He's calling it "Operation Aurora."

Trump has repeatedly invoked the Alien Enemies Act in recent days when discussing his intention to deport undocumented migrants en masse if elected, saying at a recent rally in California he would use the law “to target and dismantle every migrant criminal network operating on American soil.”

As a Canadian I'm very excited for the prospects. Even though I know that election promises will never be acted upon seriously. The simple reason why is that America is now almost to a point at which it will need to depend on cheap labour almost exclusively.

When the wealthy class destroyed most unions, they took away the workers' power to negotiate a fair wage.

That's how America's capitalism works. Enjoy!

The deportation idea is like bailing out a sinking boat while they’re still holes needing to be plugged. The smartest thing to do is plug the holes and then worry about bailing the water that’s already gotten in.

Unless… The water that’s gotten in about to sink the boat, in case you have no choice but to bail bail bail just to give yourself a little time to work on the holes. If we are at that point of needing to bail before we plug holes then that is a function of Joe Biden‘s not only allowing but encouraging massive illegal immigration.

But I believe we are not quite at that point, especially now that Trump is about to take office.

he picked the right man to get the border secured. He should let Homan be the borders Czar and pick someone else to be the deportations Czar I would recommend Marjorie Taylor Green, but only to quench my thirst for liberal tears.

Well done!

Now that you have successfully established that plans to use that act, can you explain in your own words why that won’t work? Is the act just too old or something, like the constitution?

Sure, but after this I'm all done spoon feeding you info that is readily available. The answer can be found in post #1.

Historically, the Act has been used only when Congress has declared war, and Supreme Court precedent has acknowledged that the law may only be used as a wartime authority.

Can we point out the absurd hypocrisy in this post. The left fight for equality, but at the same time, I have heard the left say that America needs immigrants for the "cheap" labor. Then at what point does the narrative switch that aliens deserve a "livable wage"?

There are still plenty of unions. My daughter is in a nurses union. Does quite well for herself. Care to interject more speculation as a non-American? And Unions today in the States, have plenty of rights and power. Trust me when I know as I have indirectly worked with the corporate labor side who has to negotiate CBAs for unions. When it takes months to fire an employee because he pissed, out of spite, on a locked bathroom door, maybe there is too much power.

The Law Hinges on the Idea of an Invasion or Predatory Incursion

Historically, the Act has been used only when Congress has declared war, and Supreme Court precedent has acknowledged that the law may only be used as a wartime authority. But its text also includes actual or threatened “invasion or predatory incursion” by a foreign nation or government. There is, of course, no military invasion or incursion occurring in the United States, so it would be unlawful for Trump to invoke the Act.

Nonetheless, invasion rhetoric has been a lynchpin of Trump’s presidential campaign. During a nomination acceptance speech at the Republican National Convention, Trump falsely claimed that the “greatest invasion in history” was happening at the southern U.S. border with Mexico, and such rhetoric has been used to justify his extreme anti-immigrant stances and policy proposals. Increasingly, we’ve seen other anti-immigrant extremists use “invasion” theory to facilitate their illegal actions. In Texas, Governor Greg Abbott has repeatedly claimed an invasion at the U.S.-Mexico border to show just cause for the entirety of Operation Lone Star, an anti-immigrant border enforcement scheme that allows for the arrest of U.S. citizens and others far from the southwest border. Abbott has even used it to justify the construction of a 1,000-foot barrier in the Rio Grande River.

The problem for those opposed to trump on this (a majority of Americans are) is his SC routinely ignores established precedent to achieve ideological goals.

I will invoke the Alien Enemies Act of 1798 to target and dismantle every migrant criminal network operating on American soil,” he said at a recent rally in California, one of several in which he has brought it up.

It’s also name-checked in the Republican Party’s official 2024 platform, which says it will invoke the law to “remove all known or suspected gang members, drug dealers, or cartel members from the United States, ending the scourge of Illegal Alien gang violence once and for all.”

Are you going to argue against doing whatever it takes to deport the gang member, drug dealers, or cartel members?

Chinese spies are safe in Vancouver!

Some Canadian political preferences are for allowing them quick and easy access to America. To the topic, I can't say if there's much of an effort by Trudeau's government to stop them?

Not arguing they are less, but still plenty of them and still plenty relevant. But their archaic ways, in many Unions, is no longer valid ways of conducting business and or negotiating on behalf of employees. Plenty of employers today, especially manufacturers, who have had unions, close those plants, reopen later with non-union plants and are successful.

Non-union plants have an advantage that often makes them more successful.

Interesting. I’m guessing the current Supreme Court will be much more accommodating to what the Duly elected president wants to do.

Trump has recently been citing the Alien Enemies Act of 1798 as his justification to enact mass deportations.

As if he had heard of it before someone told him about it. :laughing0301:

This is a guy who thinks George Washington seized the airports.

That act can only be activated in time of war.

Former President Donald Trump’s Alien Enemies Act Immigration Plan: Can He Do It?

During one of his rallies in Colorado, Trump alleged he had the authority to carry out this plan under the Alien Enemies Act of 1798, with his primary goal being to dismantle foreign criminal organizations working and living in the United States. He has since repeatedly invoked this centuries-old law as the method by which he would carry out mass deportations.

I smell Stephen Miller's stench all over this.

An Illegal Immigrant is not an Immigrant at all.
They are Foreign Nationals that have illegally entered the United States.

They have no Rights under our Constitution.
We don't need a Law to remove them ... We already have one and they are here illegally.

It's not an idea ... It doesn't matter if you want to refer to it as an Invasion or Immigration.
The Law states we don't not have to let Foreign Nationals that are here illegally stay ...

I mentioned something to someone else earlier today ...
There's a difference between fighting the fight that needs to occur ...
And pretending that winning hearts and minds will actually get the job done.

I really don't care what they may want to call me ... "Get out of my way" is sometimes the best advice I can give them.

"Lead, Follow or Get Out of the Way" ~ Thomas Paine

When Hernan Cortez travelled to the New World without permission ...
And with every intent to defeat the Aztecs in 1519 ...
He burned all but one of his ships making everyone understand ...
"You're either with me, you're going follow me into the jungle, or you can die here in the beach waiting for a ride."
