Open letter from Washington Alliance for Gun Responsibility

We knew it was coming, but not this fast.

The ink was barely dry on Seattle’s bold new gun violence tax when the gun lobby – led by the NRA and the Second Amendment Foundation – filed suit against the city to stop it.

We’re winning here in Washington and the gun lobby is in a panic. They’re used to setting the agenda, not playing defense. Now, they’re running to the courts in a last-ditch effort to stop us.

<snip>

Gun violence is out of control. If Congress and the Legislature fail to act, it’s up to cities, municipalities, and citizens to take action to support investments in public safety programs.

Seattle is standing firm and we’re backing the city all the way.

<snip>

Let’s do this.
Renée

This strategy will be a model for other like minded cities. Cities and municipalities have the right to tax, I wonder what the NRA's strategy will be to stop a tax?

.

Seattle is on the wrong side of history. Never mind the tax will do absolutely positively fucking zero to reduce any violence. Probably the opposite.

Can't do that in the Commonwealth of Virginia, Renee. State law supercedes. :laugh:

As it should until it is changed.

Is there something strange about the NRA (or anyone else for that matter) "running to the courts" these days? The NRA has a long standing legal team called the NRA/ILA (institute for legislative action) which routinely takes on cases like this.

But I thought you were against courts getting involved and legislating from the bench?

RCW 9.41.290
State preemption.
The state of Washington hereby fully occupies and preempts the entire field of firearms regulation within the boundaries of the state, including the registration, licensing, possession, purchase, sale, acquisition, transfer, discharge, and transportation of firearms, or any other element relating to firearms or parts thereof, including ammunition and reloader components. Cities, towns, and counties or other municipalities may enact only those laws and ordinances relating to firearms that are specifically authorized by state law, as in RCW 9.41.300, and are consistent with this chapter. Such local ordinances shall have the same penalty as provided for by state law. Local laws and ordinances that are inconsistent with, more restrictive than, or exceed the requirements of state law shall not be enacted and are preempted and repealed, regardless of the nature of the code, charter, or home rule status of such city, town, county, or municipality.

No…gun violence is not out of control…in fact it is going down, not up as more people own and carry guns in this country. And if they have a right to tax ammo and guns…then we also have a right to tax your ballot when you vote, and require a literacy test, have a property requirement to vote……so if one right can be infringed than the other rights can as well……..

A fallacy of false derivative analogy, but an amazingly cute one. Congrats. You can't do any of that with a ballot. Nothing says that ammo can't be taxed.

It is as constitutional to tax the purchase of a gun with the intent to restrict the right to arms as it is to tax an abortion procedure with the intent to restrict the right to an abortion.
:dunno:

That will be the argument. Both sides will argue that clean medical facilities (Tex, LA) or responsible sales (WA) are what is really happening. Who is taking away anyone's rights, are the arguments.

Probably true. Let's ship all liberals there and then build a wall around it.

The insane ones anyway and put the insane righties in Albama. Then the rest of us 95% will divide their properties.
