In answer to a question about whether he or the administration had made a formal request to El Salvador to "return" Kilmar Abrego Garcia.

"Because foreign policy belongs to the president of the United States, not some judge."

He's right. Nor did any judge have the power to order a pilot in command of U.S. military plane over international waters to reverse the course set for him or her by the chain of command.

In the Army, I was required to memorize my chain of command in several units. Not one time was there a judge in that chain.

So, what now? Will any judge hold the Secretary of State in contempt, and send a bailiff to apprehend him?

The Chief Judge of Milwaukee Circuit Courts announced that he is "working on a new policy" laying out when and where federal agents can make arrests.

Seriously?

These judges are absolutely out of control, and their insurrection must be stopped.

.

Time for another perp walk.

.

As we all sit around and eat popcorn and watch the black robe perp parade.

Judge orders Trump to lower carbon concentration in global atmosphere or face contempt!

Judge orders Trump to slow down the Earth's rotation or be jailed!

Judge orders Trump to destroy all incoming comets before they approach the Earth by more than 250,000 miles or be impeached.

Judge orders Trump to reverse Michelle Obama's sex and make her pretty or face the consequences!

A judge has the authority to determine if a persons Constitutional rights are violated

Marco knew that when he was a Senator
Of course! Marco knows that still. An American judge's job is to apply American law, of which the Constitution is the pinnacle.

If a judge wants El Salvador to do something, I suppose he or she would need to call El Salvador.

Yep and order President Bukele to return that prisoner pronto or else!

If Trump has no control over the prisoners he is paying for in El Salvador, then the courts need to order that Trump cease sending prisoners there.

Judges decide on the Constitution
In this case, it was violated
They can render an opinion but their ability to give orders is limited....something they apparently forgot. The executive branch is the enforcement arm.... The judiciary effectively has no such enforcement arm. They have every right to say they believe that the executive branch is behaving unconstitutionally. After that it's a matter of political negotiating in order to change things. They cannot become involved in the enforcement of those opinions and may just have to take " tough shit " for an answer.

Hence a Constitutional Crisis

What happens when the Executive Branch refuses to follow the Constitution?

The refusal would only be at the behest of an opinion. Now comes the involvement of the Senate and House. If they agree with the legal proceedings there are actions they can take.
If the executive branch deems the judicial opinion invalid and in its own right unconstitutional there is some room for them or it to disregard it. Is it a slippery slope? Yep. So is judicial activism.

They cannot stand up to him by its very nature the judicial branch is nothing more than co equal It is not superior as they are quickly being reminded at this point.

They get to rule on the legality of executive actions.
In this case, they ruled Trump violated this man’s rights
