The pull-over was based (presumably) on the officer's hearing of the loud music from a distance of 50 feet or more away. That does not constitute an arrest. THEN it appears that the officer asked for the DRIVER's ID. The DRIVER refused. THEN he got arrested.

See? Not that hard to follow.

If you are driving a vehicle and an officer demands to see your license you are obligated to produce it upon any request. It is an obligation of the privilege of driving.

It's in all DMV handbooks.

What you are not entitled to do is challenge the presumption on the spot since ruling that the presumption has been successfully challenged is something only a judge can do.

When a cop pulls you over, you can get a ticket or you might end up getting arrested or you might be sent on your way with none of the above happening.

The cop's subjective belief that he pulled you over for a good reason is not the same thing as a conviction, however. YOU get he benefit of a hearing or even a trial.

What is the alternative that you propose? No pulling you over before a trial or hearing? Are you seriously silly enough to think that THAT would make ANY sense?

What to do depends on what outcome you seek.

If you want to get arrested, refuse a command to produce your driver's license.

If you are content to challenge the issuance of a ticket sometime down the road, then try not to be a complete dick and instead simply produce your driver's license and insurance card and registration.
 
I challenge the word of cops on a regular basis. Objectively, cops can and do lie. Objectively, cops can and do also tell the truth.

The trick is to ascertain which they are doing when they testify.

I want cops to tell the truth. But I will challenge what they say without regret. That doesn't mean that cops are some kind of enemy.

When a gun gets fired, I guarantee I will try to run AWAY from it. Cops run toward it. They do that kind of stuff because -- why?

Driving without a license is not a mere traffic infraction. It is a violation in NY, for example. And you can certainly get a ticket, but WHO does the cop give the ticket to? Some guy named "anonymous?"

No no. To issue a ticket (instead of arresting a person) the officer has to be able to identify the person who will be required to show up in court to answer the allegations. But there's the rub. No identification = no mere ticket. Instead, the driver's imbecility EARNED him an arrest.

You could look it up.

When he gets the name from the driver, he can get the info over the radio and cross-reference it with the license plate.

You only have to identify yourself AFTER you've been LAWFULLY Arrested.

If that guy wasn't lawfully arrested then he's got a nice, juicy lawsuit against that officer.

Because if the driver gives a name it must be his real name?

Isn't it illegal to give a false name? Therefore I would assume he would give his real name which can be verified on the officer's laptop with a photo.
