Of course you can have a black market for legal items. Cigarettes are smuggled from low tax jurisdictions, they fall off of trucks and are sold, tax stamps are counterfeited.

Booze in made in back woods stills to avoid the taxman.

Independent numbers writers take wagers on lottery numbers and pay better than the state, and still profit.

Firearms are legal yet sold by unlicensed distributors as well.

It certainly changes the complexion of the black market when guys are selling otherwise legal items in an effort to avoid confiscatory taxation or draconian regulations, but it doesn't eliminate it at all.


The only solution to eliminate the "black market" for grass is a "Clean" legalization bill, where grass marketers just put up a display case next to the munchie section at Walmart or Walgreens.
