Despite being in good financial standing, adult film performers and others in the porn industry have had bank accounts abruptly terminated—and the U.S. Department of Justice (DOJ) may have had something to do with it. Under "Operation Choke Point," the DOJ and its allies are going after legal but subjectively undesirable business ventures by pressuing banks to terminate their bank accounts or refuse their business. The very premise is clearly chilling—the DOJ is coercing private businesses in an attempt to centrally engineer the American marketplace based on it's own politically biased moral judgements. Targeted business categories so far have included payday lenders, ammunition sales, dating services, purveyors of drug paraphernalia, and online gambling sites.
"Operation Chokepoint is flooding payments companies that provide processing service to those industries with subpoenas, civil investigative demands, and other burdensome and costly legal demands," wrote Jason Oxman, CEO of the Electronic Transactions Association, at The Hill.

Wait a minute, what happened to the lefts love for public accommodation laws? Legitimate businesses being barred from state and federally chartered banks, sounds like a major settlement waiting to happen.

It's not about how severe the limitations are, dummy. You ever hear of precedent? I would imagine that you do, seeing as how it's high on the list of a statist's favorite concepts.

Just in case, I'll recap it for you. Precedent is this factor in our legal system that, once a concept is accepted as legal, that concept's principle is forevermore regarded as legal.

Let's look at the principles here: Everyone in the adult film industry is not only required to undergo regular STD testing, they're often required to sign wavers before participating in their field of employment. Essentially, there isn't a single porn star out there who isn't aware of the potential risks.

Despite that, you're telling me that it's a good idea to set the precedent that the 1st amendment can be abridged in order to protect people from their own willful, educated decisions?

I get that it's okay because you don't really care about whether or not we're censoring pornography, but what happens when it's something you -do- care about?

What's more important? Freedom of speech or the government's ability to walk on the constitution to protect people from their own decisions?
