In January 2008, the Israeli human rights organisation, Yesh Din, published a comprehensive report on the implementation of due process rights in military courts in the occupied Palestinian territory.Thousands of Palestinians, suspected of security-related and other criminal offenses, are tried before Israeli military courts in the occupied territory every year. The courts have existed for forty years but, according to Yesh Din, continue to operate*in complete darkness - and without external scrutiny comes arbitrariness.Yesh Din's report examines the implementation of Palestinians' due process rights in the courts, and concludes that there are some severe shortcomings and failures. Defects are noted relating to the implementation of most of the fundamental due process rights prescribed by international law, such as the principle of presumption of innocence, the right to be notified of the charges brought against you, the right to effectively defend one self and*the right to be tried without undue delay.The military court system serves as the "cornerstone" of the Israeli occupation rule.
