In this case, the actual treaty is the UNFCCC (United Nations Framework Convention on Climate Change) of 1992. That treaty, which mandated further negotiations to limit greenhouse gases, was ratified by the US Senate. This current action is an implementation of that treaty, so no new vote by the senate is required. And if the Republicans try some tricks, the courts will smack them down, because the treaty is what it is.
