More Cincinnati City Council members were accused Thursday of violating Ohio's open meetings law by secretly conducting business via text messages.

The accusations come three months after Cincinnati resident Mark Miller sued five members of City Council for texting one another about city matters as part of "an elaborate scheme to avoid public scrutiny."

In the latest legal filing, 2017 council candidate Derek Bauman claims inappropriate communications involved other council members, too, most notably Christopher Smitherman.

Smitherman had criticized the five council members accused in Miller's lawsuit for feeding into the dysfunction at City Hall. The five council members, who dubbed themselves the "gang of five," included P.G. Sittenfeld, Wendell Young, Chris Seelbach, Tamaya Dennard and Greg Landsman.

"It turns out he was doing exactly the same thing," Bauman's lawyer, Paul DeMarco, said of Smitherman. "He was doing what he was accusing other people of doing."
