It would still be a state issue if Prop 8 were overturned. CA's law violated the US Constitution by taking away a right already granted in CA.
Actually, there was no such right. In fact, a former proposition had already explicitly outlawed gay marriage. I know the will of the people means nothing to libs though.

The will of the people means a great deal to liberals.
But the people are subject to the rule of law, as are their elected representatives. Consequently, ones civil liberties are not subject to majority rule, the majority doesnt determine who will or will not have his rights.
Concocting "fundamental rights" has gotten out of control. The "union" of two men or two women and eventually a group of men and women is not and never will be a real "marriage."
It's been all downhill since the courts invented the "right" to commit murder of the unborn.
America needs to wake up and put an end to the invention of outlandish "fundamental rights." It's crazy.
