On November 21, 1999, EliƔn's mother, her partner, and EliƔn fled Cuba by boat as part of a group of refugees attempting to reach the United States. The boat sank during the journey, and EliƔn's mother, along with most of the passengers, drowned. WTF are you talking about? Your own text says there was a protracted custody battle that was ultimately won by the child’s father.

That’s due process.

Elian was in the custody of a parent, who stood in for his due process.

This case went up to the New York Court of Appeals. That's plenty of due process.

He never had an asylum hearing because the court said he was too young to even ask for asylum. His custodial parent, his father, had to make the application on his behalf.

His father wanted him back.

Even as a child I knew this was wrong. Due process knows not age, race, nor whether you are a criminal or law abiding citizen.

Elian had Constitutional Rights that superseded parental rights

a STATE COURT had to determine what was in the best interest of the child
 
Unfortunately in this case a father's rights to decide his child's upbringing trump the great-uncle and dead mom. If he wanted Elian back, then he should go back.

How much his father really wanted Elian to return and how much he was being leaned on by the Castro regime is impossible to answer.

In any case, Elian went back to become a propaganda tool for Castro. He was well taken care of in that respect.
