Sniff.. sniff... New Mexico police departments are crying about the fact that a person actually has to be treated as innocent until proven guilty before they can seize their cash or property and auction it off to pad their departments' budgets. Can you imagine the hassle? Damn civil rights.

Good. Ive never supported the asset seizure protocols. Understand the intent...but it grew way out of hand.

What the fuck? I didn't even know they were allowed to do that in the first place. :dunno:

It has taken NM until 2015 to protect innocent people from having their property confiscated by the cops?

Does this mean that the civil asset forfeiture law in the United States has been overturned? I understand it was first used and put into action by the Obama administration and it looked to me as if it was being used as an incentive by the Obama admin to law enforcement to persuade them towards corruption and compromising their integrity. (doing what they knew was wrong - but because it benefited them - turning a blind eye to the truth that it was theft of private property).

Excuse me, it was under the Obama administration that it spiked - the chart shows it began in 1990? But look at what happened under his administration. Clearly these laws began to exploit the American people as never before!
Civil asset forfeitures more than double under Obama - The Washington Post

The Post piece notes that under civil asset forfeiture laws, the burden of proof is on the owner of the assets to show that they are not related to a crime by a legal standard known as preponderance of the evidence. In essence, you're considered guilty until proven innocent.

The process has proven controversial -- this summer Senator Rand Paul introduced a bill to reform the practice, as did Michigan representative Tim Walberg.

You understand that the Civil Asset Forfeiture Reform Act of 2000 was first used under Obama? Like usual, you understand wrong.

They are only one of two states so far to have done it

And yet the IRS can do exactly that to innocent, uncharged citizens and you people are okay with that.

It's about damned time. There was a man murdered (they claimed self defense of course) by a LASO deputy a couple of decades ago and the sole reason for the raid was determined to be the lead investigator wanting to confiscate the mans ranch.

I guess you'll have to whine about all the other states that still allow it...

The cops have never been very fond of the US Constitution of the United States Of America and the 4th amendment. Policing for profit is out of hand. There are a lot of cops who hate the shit that their bosses are telling them to do. Some cops take their oath seriously.

You're definitely right about that. And more and more are getting on board.

Cops are losing support from the left and the right. That's too bad because we need people to enforce our laws but too many cops break the law.
