The constitution States that no person with the responsibility of handing one of our agencies, that reports direct to the President, which Whitaker as acting AG does just that, can sit in the position without the advice and consent of the Senate.... and other laws written specifically for this..... in order to keep the department heads of agencies reporting directly to the President from becoming an "arm" of the president, that could be corrupt and the Senate is suppose to vet these people up and down and inside out, before they approve them.

Also, there is a law in place that gives the directions for the succession of who would be the head's replacement....

for the constitutional purpose above that was mentioned.... the Senate has to also give their advice and consent on the Deputy Attorney General and the Solicitor general.....and two other positions in the justice Dept have to be approved and consented by the Senate also, because they are in the succession of who replaces the AG when he resigns or is fired or dies. this allows the position to not be empty and an acting AG can be there immediately from this succession line, until the new AG appointed by the president can be vetted through the advice and consent of the Senate.

Rod Rosenstein or the Soliciter General, should have moved directly in to the AG position as acting AG.

Whitaker is there illegally and unconstitutionally.

He recused himself, because he was involved in the Trump Campaign, and the Trump Campaign was being investigated.

He did not do this on his own, Sessions followed protocol and presented his case to the Ethics Committee and it was the Ethics committee that told him that he should recuse himself from the investigation.

Sessions truly had no choice, if he wanted to keep his name honest and keep his law license.

Trump may try to say the Senate had already vetted him, 14 YEARS AGO, for a prosecutor's position in one of the States, can't remember which one...GWB appointed him.

BUT, a lot can happen in 14 YEARS and he was NEVER vetted for a position that reported directly to the President...

Also, Trump really doesn't have the best talent out there as lawyers to the President.... no smart lawyer, wanted the position.... President Trump never listens to advice.... never follows the advice of his own personal lawyers either.
