Constitution says a majority

Court decisions are on how the law is applied. Why should a minority decision dictate how the law is applied?
 
Actually simple majority is nothing else but a clusterfuck. Every law should be passed by 2/3s of majority. Every presidential election should be decided by 2/3s majority of the votes and if necessary hold run off elections until it is reached. Simple majority divides the nation down to half.
 
The Same Sex Marriage decision was a decision on whether the 14th amendment applies or not

Why should four of nine judges get to decide that it does not apply?

The problem with that idea is that it creates a gray zone where no ruling can be offered and no resolution can be met. As a 5-4 ruling would neither overrule nor uphold a lower court ruling.

Then congress would rule on the constitutionality of their own laws. Congress would be completely unchecked.

They can pass an amendment. Suppose Congress does not like the Supreme Courts Heller Decision, they can vote to repeal the second amendment with the states concurrence

They can pass an amendment. Suppose Congress does not like the Supreme Courts Heller Decision, they can vote to repeal the second amendment with the states concurrence

Congress can't pass an amendment. Their checks with the court come in the confirmation process and in the jurisdiction of the federal judiciary. Congress can limit the topics that the court is allowed to review.

Amendments are overwhelmingly a State matter. And can be initiated and passed with virtually no congressional involvement at all.

If you allow Congress to decide that its laws are constiutional- just pass an amendment stating that any law passed by Congress is automatically Constitutional.

It would be what you are saying.
 
Look at this this way -- now that liberals have 3 cases that went 5-4 in their favor, they are less likely to argue that DC v Heller means less (or nothing ) because it too went 5-4.

If they want to remain consistent, that is.

When the vote is 9-0, I'm pretty sure SCOTUS got it right. When it's 5-4, not so much.
