Teacher Reportedly Seizes First-Grader?s Christmas Gifts and Trashes Affixed Religious Story - The Federalist Papers

This shit has taken on almost comical proportions.

"A first-grade teacher in California told a student that “Jesus is not allowed in school” before removing a religious story the child affixed to candy canes in celebration of Christmas last month, a non-profit legal firm claims.

The incident reportedly unfolded on Dec. 13, when 6-year-old Isaiah Martinez brought gifts for his peers to Merced Elementary School in West Covina, Calif.

According to a press release distributed by Advocates for Faith & Freedom, the firm handling the case, “Each gift consisted of a traditional candy cane with a message attached that recited the legend of the candy cane. The legend references a candy maker who created the candy cane to symbolize the life of Jesus Christ.”"

"“After conferring with the school principal, the teacher told Isaiah that ‘Jesus is not allowed in school’ and, at the apparent direction of her principal, ripped the candy cane message from each candy cane, threw the messages in the trash, and handed the candy canes back to Isaiah for delivery to his classmates,” the press release continued. “Isaiah then nervously handed the candy canes to his classmates in fear that he was in trouble for trying to bring a little Christmas cheer and ‘good tidings’ to class.”"

This is, if true and accurately reported, a case of over reaction and certainly could've been better handled. However, the principal is right when saying that Jesus doesn't belong in school - public school that is - except for maybe a religious studies class. The same for Moses, Mohammed, Buddha, etc.

I don't see how this is a partisan issue. I know Christians who would categorize themselves as politically left. I think they would agree that public schools must maintain a secular position in order to respect students and students' parents of varying faiths. That doesn't excuse this teacher or principal for their over reaction.

This isn't a lefty issue but an ignorance of the law issue. Students are free to express their religious faith so long as it's not in a distracting or disruptive manner. Personnel though are not since it's considered endorsing religion.

"May students express their beliefs about religion in classroom assignments or at school-sponsored events?

Yes, within limits. Generally, if it is relevant to the subject under consideration and meets the requirements of the assignment, students should be allowed to express their religious or nonreligious views during a class discussion, as part of a written assignment, or as part of an art activity.

This does not mean, however, that students have the right to compel a captive audience to participate in prayer or listen to a proselytizing sermon. School officials should allow students to express their views about religion, but should draw the line when students wish to invite others to participate in religious practices or want to give a speech that is primarily proselytizing. There is no bright legal line that can be drawn between permissible and impermissible student religious expression in a classroom assignment or at a school-sponsored event. In recent lower court decisions, judges have deferred to the judgment of educators to determine where to draw the line. (C.H. v. Olivia, 2nd Cir. 2000)

Does the establishment clause apply to students in a public school?

The establishment clause speaks to what government may or may not do. It does not apply to the private speech of students. School officials should keep in mind the distinction between government (in this case “school”) speech endorsing religion — which the establishment clause prohibits — and private (in this case “student”) speech endorsing religion, which the free-speech and free-exercise clauses protect.

Student religious expression may, however, raise establishment clause concerns when such expression takes place before a captive audience in a classroom or at a school-sponsored event. Students have the right to pray alone or in groups or to discuss their faith with classmates, as long as they aren’t disruptive or coercive. And they may express their religious views in class assignments or discussions, as long as it is relevant to the subject under consideration and meets the requirements of the assignment. But students don’t have a right to force a captive audience to participate in religious exercises.

So this isolated incident is proof that the poor christians are being victimized by the left?

OH!! The melodrama.

But, I do agree with one line from the op -

This shit has taken on almost comical proportions.

This is still the US and we still have a Constitution. Just deal with it and quit whining.

This is a lie, and the OP is a liar.

Nowhere in the cited source is the teacher identified as being ‘left,’ or ‘far left,’ for that matter.

Moreover, there’s no evidence the teacher is ‘left,’ rendering your premise false.

You’re a liar because you’ve identified the teacher as being ‘left’ absent any evidence, and you’ve compounded your lie by falsely ascribing the teacher’s opinion concerning religion in schools as being condoned by those on the left, which they do not. In fact, the vast majority of liberals are Christian, and even more persons of faith.

Now do you understand why Conservatives long for the more decent and innocent yesteryear, even before the very recent time before Whitewater?

Disingenuous LEFTY douchebag ^^^^^^^^

Disingenuous means being untruthful.

I read the article too and couldn't find any mention of "left".

Where was he untruthful?

Please show where, in the article, it says the teacher is "left".

Thanks.

"decent"

You mean, like before the United States had the Constitution?

Who the fuck other than a Leftist or a Communist or an aetheist (who, as Conservatives can tell you, abound!) would do such a thing?

And Conservatives find them all to be repugnant, for the most part.

Anyone who'd make an argument such as the one you have, has revealed a rare ability.

You can post hundreds and thousands of times against a group you know NOTHING about.

Until further notice you are to be known to one and all as being unable to understand your Conservative opponent.

ANYONE who'd do such a thing as was cited in the OP is in the same barrel of feces as Liberals.

And to argue that one is better or not as bad as another is important only to ignoramuses like yourself.

They (you?) are ALL feces to me.

The establishment clause applies to the government. If students want to have a prayer at their commencement then they can do so. The SCOTUS has found that constitutional. The school, however,l can't arrange a prayer at commencement. This was a little child, and nt a government employee. He had every right to bring gifts with a religious sentiment to the other children. I hope the teacher loses her stupid ass.

The NEA is notoriously leftist. Of course the teacher was a leftist. Her union tells her to be.

It's okay, God plans on destroying everything in this world soon, including ALL the disobedient people who call themselves Christians. They are actually antichrists who use the words of God without any authority to do so. It was the Vatican who made new laws for Christianity that were contrary to the laws that we saints speak. Christians obey these religious laws instead of the laws ( commandments ) of our Creator.

Atheists who slam Christianity and defend islam seem unable to realize that THEY are the infidels. A Christian would fare better with islam than an atheist. And that still wouldn't be very good.
