When it comes to a vote to reopen funding in the government, the majority of House votes would create a resolution to fund the government. The GOP does not have the majority of votes to keep up with the partial shutdown the government is under as of now. This is why they do not want a vote.

To keep the vote at bay, Republican members of the House Rules Committee came up with a plan to keep what is known as a “clean” continuing resolution off the House floor. Without a vote and without the CR, the government remains in shutdown mode.

At least 28 House Republicans have admitted they would support a clean CR if the offer was brought to the floor. This would give enough votes for the government to reopen when incorporated with the Democratic support that is already there. Republicans implemented a House rule prior to the shutdown that would prevent the vote from occurring.

Rep. Chris Van Hollen, a Democrat from Maryland, brought this to everyone’s attention on Saturday, as he presented a motion to accept the Senate’s clean continuing resolution and re-fund the government programs currently shutdown.

Jason Chaffetz, a Republican Rep. from Utah was presiding over the chamber. He told Van Hollen the rule he was wanting to use was already altered and he could not use it to bring the vote to the floor.

House Resolution 368 was in place and decided the standing rules.

Any member of the House could have brought the CR to the floor under House Rule 22, although the quietly passed House Resolution 368 was put into place on the night of the shutdown. This left the House majority leader, Rep. Eric Cantor of Virginia in the driver’s seat when it comes to the vote.

Van Hollen asked:

“
The Rules Committee, under the rules of the House, changed the standing rules of the House to take away the right of any member to move to vote to open the government, and gave that right exclusively to the Republican Leader. Is that right?”

Chaffetz replied:

“
The House adopted that resolution.”

Van Hollen replied:

“
I make my motion, Mr. Speaker, I renew my motion that under the regular standing rules of the House that the House take up the Senate amendments and open the government now.”

Chaffetz informed Van Hollen that under section 2 of H.R. 368, that motion could be offered only by the majority leader or a person designated by him to bring the vote to the floor.

The bill was suspended due to the refusal of a clean vote by the GOP under the implementation of the H.R. 368 Republicans put into place before the shutdown, making it impossible for Democrats to bring the vote to the floor.

The Republicans have implied that Democrats are the hostile members of the House, causing the breakdown of communications and hesitation in wanting to negotiate. With negotiations such as these, the government shutdown will become a reality in the next few days.
