No. The SCOTUS ruled n 1948 that immigration was that of politics and as such not up to appointed judges. It was codified in 1952 that the POTUS had authority to ban entry by "any aliens or any class of aliens."

The court has effectively gone against itself and the law. They will be overruled.

I agree with you. We know that the White House adviser made a double down effect on the evidence of voter fraud in New Hampshire. ABC Chief Anchor George Stephanopoulos questioned Miller is there any evidence, and Miller refuse to answer.

The Constitution does not give the Judiciary the power to overrule the the other tow branches of government. The federal courts in Seattle and San Francisco have gone rogue on this issue, issuing opinions that make no reference to law or accepted procedure in order to make a political statement. This is a clear abuse of power and constitutes an impeachable offense under the Constitution's condition that Article III federal judges will hold office "during good behavior". Fifteen federal judges have been impeached and it appears a few more should be now.

Legal decisions are not made in a vacuum. It is important to examine what the Executive branch of government is up ro when making a legal challenge.

Recall 1952 law which you cite was made at a time when the United States was fixated with a perceived Communist threat. This time was characterized by hatred of Americans who were of the Left and Reds under the bed paranoia was accepted as normal. The anti-Communist Senator McCarthy was making a career going after all groups of people including Hollywood writers, producers, and actors. At a hearing of the un-American Activities Committee, Robert Taylor got an applause when he said of Hollywood talent that they should all be sent back to Russia.



Immigrants were targeted then as they are now under the barely literate so-called President Trump. Section 212(f), of the Act you cite states: "Whenever the President finds that the entry of any aliens or of any class of aliens into the United States would be detrimental to the interests of the United States, he may by proclamation, and for such period as he shall deem necessary, suspend the entry of all aliens or any class of aliens as immigrants or nonimmigrants, or impose on the entry of aliens any restrictions he may deem to be appropriate."

The USA is a very different place since 1952 and Trump's ban on Muslims from specific countries defies the 1965 amendment signed by Democrat President Lyndon Johnson that changed the composition of immigration into the U.S. by eliminating discriminatory quota imbalances and stipulated that immigrants could not be denied a visa because of their race, sex, nationality or place of birth.

After BO called them out for Citizens United they are not about to convey Constitutional Rights to potential foreign terrorists. Judge Janine and Judge Napolitano said bluntly that WS has ZERO standing to even bring the suit on behalf of foreign nationals. This case will be cleared up soon.

DJT will need to seat his first SCOTUS to justice in order to win this.

Otherwise the other 4 Communists on the high court will overrule him and it will be a tie and then the 9th Circuit ruling will stand.

Actually if they vote as conservatives, they will vote against Trump. Trump is the one trying to make law. Immigration is the purview of Congress. They make the law and the President signs the law. The fact is that there is no law that allows a President to revoke visas and green cards of people who have undergone months of vetting en masse.

Washington state does have standing as their faculty and students have been affected by the ban. The 9th Circuit opinion was well written and one that 2 Democrats and 1 Republican agree on.
 
It's quite likely that the left thinks the 9th circuit court is "supreme" even though it has been reversed in about 85% of it's decisions but the only thing that is really "supreme" of course is the United States Constitution.
 
A broken watch is right twice a day. It is possible for them to get something right. The 2 Democrats on the panel actually showed some smarts for once. The reason the court reserved opinion on issues like religious discrimination was that they decided to put into the opinion something that would be unanimous.
