Perhaps so but the reality is she is going to be confirmed and her confirmation doesn’t change the makeup of the court. Since the 60 vote threshold for confirming both lower court and Supreme Court justices was eliminated for the simple majority vote there is little to no chance a nominee won’t get confirmed.

Her confirmation has the the ability to change direction of the court. I'm sure Kagan and Sotomayor now have a partner in ideology.
