Probably a good reason to not belong to MS13 or to be arrested then. If someone arrested me to send to prison, guess how far my argument that arresting me might cause me to lose my house or default on bills would get me?

Well I’ll tell you what gets me is that they claim Garcia is not a gang member but he’s afraid of a rival gang getting to him if he goes to El Salvador. That was his claim for asylum!!!
 
I have asked right here on the forum many times of those that support Garcia would they take him into their home so far I’ve got zero answers.

Good point. Can you imagine people petitioning for El Chapo's release because he is such a big criminal, so wanted by rival gangs, that his life would be in danger if we were to send him home to a Mexican prison?

Meanwhile, did you hear one democrat calling for the protection of J6 prisoners because the treatment was too harsh? One guy committed suicide over the treatment, and he was just at the capitol that day, did nothing but look and walk around.
 
Actually, you can have a claim for asylum denied, but a request not to be deported to a specific location granted.

The individual in question was deported to his home country, as is customary. Actually even that is not necessary, it's considered a courtesy. Technically we can escort him to the border and watch him walk to the other side. That is considered sufficient by most countries.

The judge issued a "withholding of removal" order, due to Garcia claiming he would be in fear of his life if deported to El Salvador.

The part(s) of the US Code that allowed that order are:

1) 8 U.S.C. § 1231(b)(3)(A)
2) 8 U.S.C. § 1231(b)(3)
3) 8 C.F.R. § 208.16(c).
4) 8 C.F.R. § 1208.16(c)

It's not customary when the order forbade his deportation to El Salvador.

SCOTUS cited 8 U.S.C. § 1231(b)(3) in it's 9-0 ruling ordering the US to facilitate his return, saying he needed his due process by appearing before an immigration judge and given proper notice of removal. It also stated that the government did violate a standing order of withholding of removal.

The government never terminated the order, and to terminate the order, the government must provide grounds for termination, and if granted, give another hearing to the person in question.

All illegal aliens are subject to deportation. That is the law.
He had legal protection from deportation to El Salvador. That was the law.

So where's this proof of his life being in danger? TRUMP has shown proof of gang connection.
Kitty, why are you twisting yourself in to some contorted shape, on this issue? There was a court order, where a judge was shown all the evidence of his life's jeopardy if sent there....the Judge accepted it as valid. A court order was issued protecting him from deportation there. The Trump DOJ could have appealed the ruling at the time, but chose not to....likely because they believed the story and whatever proof shown.

And if this new Trump DOJ or Homeland security wanted to
deport him to ElSalvador, the law required them to return to the court with Garcia, and make a request to the court, for the protection order, to be removed/rescinded.

8 USC 1231 states as follows:

A) In general​

Notwithstanding paragraphs (1) and (2), the Attorney General may not remove an alien to a country if the Attorney General decides that the alien's life or freedom would be threatened in that country because of the alien's race, religion, nationality, membership in a particular social group, or political opinion

Note the bolded and underlined part. Specifically not some dumbass immigration judge. Who isn't even a real judge, just an administrator.

8 CFR 1208 16C refers to TORTURE. There is zero evidence of torture in any of these cases.

8 USC 1229 states as follows:

(d) Prompt initiation of removal​

(1) In the case of an alien who is convicted of an offense which makes the alien deportable, the Attorney General shall begin any removal proceeding as expeditiously as possible after the date of the conviction.

It was Obama's job to DEPORT this individual after the very first deportation order, and he failed.
