Wow! This is awesome. At long last a governor of a state has the juevos to stand up to the Feds on this subject. Utah is only asking for 31.2 million acres of land. Here's a list of what the Feds control @ List of federal lands in Utah - Wikipedia the free encyclopedia


I know that about 90% of Nevada is under federal control and am certain other western states are similar. Just wonder if they can manage to succeed in this – and have it stand up in SCOTUS, for that's where it's bound.

Utah, when it became a state in 1896, gave up legal right to the 2/3ds of the land still owned by the US.

Spain, then Mexico, then US, then Utah got a 1/3d share of the land it never owned.

Gary Herbert et al don't have a chance if the US won't give it up willingly.

State court decisions don't count, and the federal courts will not give to Utah what it never owned.

End of story.

A follow up on yesterday's story about Utah taking back federal lands they believe belong to the state. I have no problem with the National Park Service but have some serious misgivings about the other agencies.

The government owns the land because the territories then states were formed out of federal land.

All you corporatists and far right fascists and libertarians better shut up if you won't admit your desire to take land not yours violates your supposed principles. The corporatists have none.
