I have a general policy that when something*****es me off enough to want to throw things at my TV I go have a drink and refuse to write on it until having slept first.

Sometimes I wake up with a different perspective.

And sometimes not.

This is one of the "nots."

Last night, unless you live in a cave, you know that the second bombing suspect was captured alive. The first one died from a combination of bullets and being run over by his brother in a carjacked vehicle trying to escape.

Yeah, that really nice kid who we now have in custody ran over his brother.

But let's take a look at the facts, shall we?

Instead, within a half-hour of the "can't find our ass with both hands" cops giving up on locking down the town an ordinary citizen finds the bad guy in his boat.

In 30 minutes "We the people" do what thousands of cops spending millions of dollars and violating the rights of every citizen in the town could not and the people did it without all that fancy military hardware too.

Authorities identified and neutralized the suspects in a remarkably short period of time. It was done in an efficient and timely manner, with co-operation among many difference law enforcement entities.

There was no 4th Amendment ‘violation’ as the investigation clearly falls under the exigent circumstances exception, where law enforcement "who have established probable cause that evidence is likely to be at a certain place and who do not have time to get a search warrant.” The exigent circumstances exception is justified where the situation ” include danger of physical harm to an officer or others…”*

Clearly, known terrorist suspects at large pose “danger of physical harm to an officer or others”; indeed, the suspects were alleged to have been involved in the killing of an MIT officer, establishing probable cause and a reasonable expectation that the suspects were prepared to visit physical harm on citizens and police officers alike.

And there was no ‘martial law,’ to claim such is ignorant idiocy. Martial law can exist only where there is actual war occurring in a given jurisdiction, and where the courts have ceased to function in that jurisdiction. See: Ex parte Milligan (1866).

The blog author is clearly a rightist partisan hack, concerned not about facts, the Constitution, and the law but that the spin and lies by conservatives are failing to manifest a false narrative that the Administration ‘failed’ to prevent a terrorist attack.

Law enforcement faced with what they believe is a major emergency, will violate every amendment in the Bill of Rights. We have been violating civil and human rights throughout our history. Looking back at what occurred in Boston, we are quick to condemn the authorities, but hindsight is perfect. Had the police stopped another bombing and saved hundreds of lives, there would be no mention of rights violations.

I didn't know that the Bill of Rights could be ignored by the police when the police think that it is convenient. In fact I though the Bill of Rights was there to keep the authorities in line.

Of course had the cops do what they normally do, there wouldn't be any mention of it at all past the initial news report.

Case in point, the cops seized the following outside of Phoenix...

That's 6 tons of pot, along with 2.4 million in cash, a few dozen weapons, some other drugs, cars and airplanes...

The cops who busted the cell may have gotten the weekend off as a reward. As most have exhibited here, taking potshots at anyone is easy, fun, and penalty free. Perhaps we should have a kinder eye toward those who have the difficult responsibility of doing the job at the time and not having the benefit of hindsight or how it will "play" in the press or on message boards.
