Scalia did not invent originalism. He may have ignited a more widespread usage of the term, but criminy, that journalist is no journalist.

On the limits of tribunal jurisdiction, Thomas Jefferson considered the Constitution’s application amid the context of history, the Federalist Papers, and the spirit of the American Revolution. In a letter to Judge William Johnson, he said, “On every question of construction, [let us] carry ourselves back to the time when the Constitution was adopted, recollect the spirit manifested in the debates, and instead of trying what meaning may be squeezed out of the text, or invented against it, conform to the probable one in which it was passed.”
 
Historic context counts, but don't forget that the writers of The Constitution couldn't live up to the ideals they were putting on paper.

They compromised away the concept of "Liberty and Justice for All" for the profitability of human slavery. That's a pretty big compromise.

Well, in all fairness, according to this source there could be as few as 5,000 accused since 1950....or maybe it is 10,000... Somewhere around 5% of priests in the US.

Doing the math, that's about 91 per year.

Well, then. Maybe only 100 new pedophile priests per year in the USA! With an example like that, it is an enigma why Catholics are the fastest declining religious membership in the country!
