It depends on what was expunged, an arrest or a conviction. Generally speaking, it does not have to be disclosed when applying for a job.

If she was under oath, she would most likely have the obligation to disclose the existence of the expungement, but not the details.

Typically an arrest is not expunged after a conviction.....only the conviction is expunged. Not the arrest itself as a file now exists in the CJS of the arresting body of law.

An arrest expungement is beyond the scope of what is normally performed. It takes a whole bunch of political pressure to have it done. Or a person being of such good character that the arresting officers are almost fired for detaining this well known moral person and the pressure comes from the public itself.

If her arrest record has been “expunged”, then she has not been arrested. An arrest is only expunged if it is illegal improper or should never have happened.

She’s being attacked by pro life groups because she protects women’s rights.

This is right wing judicial harassment. This woman has done nothing wrong, and she did not lie to congress.

I did a little digging and looked at the forms. She was required to disclose expungements of any arrest or conviction in the last 7 years.

2006 was the arrest, 2008 was the expungement. The expungement was both police and court records, which I assume would include the arrest.

2021 was the appointment, so that is more than 7 years, and she wouldn't have to disclose.

If it was a DV conviction, she was required to disclose the expungement even though it was older than 7 years. If it was only an arrest and no conviction, she doesn't have to disclose.

(That is rule for her employment- not necessarily the same as her confirmation hearing, or if she got a security clearance)
