Breaking: Justice Scalia has died

... what do recess appointments have to do with the current situation...?

Well duhhh. The President cannot force Mitch McConnell to bring his SC nomination to the floor. His only real option might have been to make another unconstitutional recess appointment when Congress takes a recess.

Unless the Senate does a pro-forma session like the house did in 2011.
The Senate will be in session this week and I fully expect Obama to announce a nominee.

That is his right and duty to do so.
The Senate Majority also has the right to not bring it up or to vote against it.
The Senate does not get to pick and choose which presidents get to appoint replacements.

True, the President has every right to submit his nominee's name to the Senate Majority Leader for a conformation vote. No President can tell the Senate Majority Leader when to bring anything at all to the floor of the Senate however.

So what kind of precedent does this set our country up for? When your party doesn't like a nominee (before they're even announced) because it's from a president in the opposite party you just block it until you get a president from your party?

If Republicans win in 2016 do Democrats just block all the nominees until 2021??? What's the plan here?

It is not about liking or not liking, it's about both parties using it in their Campaigns against each other.
The appointment should not be made political at all, yet both sides are doing it.
This is wrong.
We should wait till after the November elections and then appoint one.
The Supreme Court is almost over for this session and they can handle it fine until they go back to work in Oct.

There has never been a time the US government waits a whole year before even voting on a nominee....Obama is just doing what is in the constitution, it's the Republicans attempting to capitalize on it politically.

What in the world is Obama doing that is abnormal about this?? A Justice dies, he nominates someone, Senate gives a vote. It's a pretty simple process.

Yes, I agree so the point is?
Yet that is what the Senate is saying they are going to do.

Why should we wait? You just agreed the Senate doesn't get to pick and choose which president gets to appoint replacements; so what reason is there not to consider whom Obama nominates?

Perhaps you don't comprehend the distinction between "nominate" and "appoint?"

There are Republican Senators who said that. The post I responded to was defending their position.

Despite your opinion, the Senate cannot tell a president they cannot appoint a replacement. Your post was defending these proposing to do just that.

No they didn't, they said they would not confirm and that is their right.

The give away was when he messed up and used the word adults in another thread. :)

Yes, they did say that. And you just said they don't get to pick and choose which presidents appoint replacements yet here you are defending their position. It's like you don't even comprehend the issue.

And why no answer to Nyvin's question. Since you support this bizarre notion that the Senate can prevent a president from appointing a replacement, why can't Democrats block the president from filling that seat until 2021 should a Republican win the presidency?

Is English your second language? Telling a president they will not confirm their nominees is the same as telling the president he/she can't appoint a Supreme Court justice.

You really have no fucking clue what's being discussed, do you?
