Republicans had a conniption fit over the FBI investigation into David Petraeus, and the classified infomation during his tenure as CIA chief. REMEMBER? Now we've been through many Clinton investigations over the years, and the Reich wing is never satisfied with the results, so they demand more investigations, and at great taxpayer expense to come up with the same result (always) as the first one.

"Republicans have long insisted that former CIA Director Gen. David Petraeus' mishandling of classified information was far less egregious misconduct than Hillary Clinton's private email use while leading the State Department.

The talking point has gained steam this week after FBI Director James Comey recommended that the Justice Department bring no charges against Clinton, with presumptive Republican presidential nominee Donald Trump even suggesting a nefarious motive behind the decision.

On Thursday, Comey was given an opportunity to rebut some of those charges during a hearing on Capitol Hill before the House Oversight and Government Reform Committee.

"The Petraeus case, to my mind, illustrates perfectly the kind of cases the Department of Justice is willing to prosecute," Comey told the committee.

Petraeus, the four-star general who oversaw military operations in both Afghanistan and Iraq, resigned as CIA director in 2012 after his extramarital affair with his biographer, Paula Broadwell, became public.

The FBI and Justice Department later recommended felony charges against him for sharing classified information with Broadwell. He ultimately avoided jail time after pleading guilty to a misdemeanor last year, resulting in two years probation and a $100,000 fine. At the time, members of Congress from both sides of the aisle rallied to Petraeus' defense and criticized the Justice Department for pursuing the case.

At the hearing on Thursday, Democratic Rep. Elijah Cummings, the committee's ranking member, invited Comey to counter those claims.

Comey pointed out that Petraeus not only shared the classified information, but also hid the documents in his attic and then lied to investigators.

"So you have obstruction of justice, you have intentional misconduct and a vast quantity of information," Comey said. "He admitted he knew that was the wrong thing to do. That is a perfect illustration of the kind of cases that get prosecuted."

Because he stressed that her actions were not criminal. Careless? Yes. Foolish? Perhaps. Arrogant? Probably. Stupid? Possibly. Criminal? No.

The law is the law. It's not a stick to be used by politicians to beat their opponents into submission and slander their reputation. What she did was the modern equivalent of leaving sensitive information on her desk in her locked office rather than putting it in a lockbox in a vault. Doing so could create a vulnerability, because someone could pick the lock to her office and steal the information. But all that did was create a vulnerability, not a breach. Unless they can prove such a breach occurred, and definitively say sensitive information was obtained by unauthorized personel as a result, this is much ado about nothing.

The law that they were attempt to indict her under was the Espionage Act of 1917. Here is the US Code derived from it. 18 U.S. Code § 798 - Disclosure of classified information If Walt Whitman and Herman Melville had an overly verbose baby that decided it wanted to write a law, it would write the Espionage Act of 1917, and I'm not posting the full text of that garbage here.

There is nothing in the entire text of the law that mentions "unsecured channels". The elements it relies upon are relics from a time when everything had a hard copy and any breach would have to be physical. That is the point: Emails inherently create copies without intention of storage, duplication, or distribution. Computer hacking allows for access to the information without knowledge of or access to any of the parties or materials involved. In fact this type of "access" (computer to computer) literally did not exist and had not been conceived yet when the law was written. The last revision to the act predated the first email by over 20 years. Because of these facts, someone could cause a breach and not do so knowingly or willfully, and because of this be completely untouchable under the law.

THAT is the point that Comey was making. He stressed many times that what Hillary did was extremely careless, she shouldn't have done it, she lied to the public, etc. None of that was disputed. What he was saying was that the law itself is INADEQUATE for today's times. The State Department knows the score and sets rules accordingly. They have their own regulations about what their employees can and can't do. If an employee violates them, as Clinton has surely done, then they can discipline them within the restrictions allowed as their employer. They can fire them, suspend, them, or revoke their clearance. That's it. The State Department can make recommendations regarding the laws, but it's up to Congress to legislate.

Hillary lying proves nothing with regards to legality. It makes her look foolish, irresponsible, and untrustworthy if the narrative shifts to how she can't follow security protocols and repeatedly endangered state secrets. Criminal charges be damned, she had a lot to lose by this coming to light. If she wasn't facing a shaved orangutan with dementia in 2016, she'd have probably just lost the election.

Here we have the CIA DIRECTOR, David Patreaus giving classified information to his mistress so she can write a book about him, who then lied to the FBI, then admitted he lied, and also admitted he committed a criminal act by giving classified information to her.

Versus

Some of Hillary Clinton's emails were marked classified (after she received them,) as what happened to Colin Powell and Condi Rice's emails. They didn't deliver classified documents to anyone that wasn't authorized to receive them. They didn't lie to the FBI, and they didn't try to hide anything from the FBI. Unknowingly Hillary Clinton had an IT Senior Staffer working at the State Department set up a private server in her home, and this Senior IT staffer who worked at the State department also maintained the server. If anyone should have known state department rules regarding private servers, one would think it would be a Senior IT staffer working at the State Department. He's probably done it for others, but it was never an issue until now. He also received immunity from the FBI to save his own ass. IOW there was no INTENT on Hillary Clinton's behalf to break protocol or rules or committ a criminal act, much less deliver classified information to people who were not authorized to receive classified information.

And it famously prosecuted Gen. David Petraeus for sharing paper copies of his daily calendar in his guarded home with a military colleague also in the home — Paula Broadwell had a secret security clearance herself — because the calendar inadvertently included secret matters in the pages underneath the calendar.


There was NO MENS REA that the General INTENDED TO CRIMINALLY HARM THE US.

So STFU.

I don't equate the two cases. They are completely different. One made a singular bad decision and deserved everything he received. The other made continual, habitual sins regarding security and gets a pass.
