Gay Marriage: Another broken Obama campaign promise

Remember when Obama was saying that gay marriage was a states issue. Apparently, that was just him saying anything to get elected, as usual.

It is a states’ issue, where they should be allowed to compose marriage law as they see fit.

The problem is the states fail to obey the Constitution, forcing same-sex couples to seek remedy in Federal court.

So although the states are allowed to compose marriage law as they see fit, the 14th Amendment requires the state to allow all persons access to those laws, including same-sex couples.

Thus the president didn’t ‘lie,’ the fault lies solely with the states and their failure to follow the law.

It would still be a state issue if Prop 8 were overturned. CA's law violated the US Constitution by taking away a right already granted in CA.

Actually, there was no such right. In fact, a former proposition had already explicitly outlawed gay marriage. I know the will of the people means nothing to libs though.

Prior to November 4, 2008, the California Constitution guaranteed the right to marry to opposite-sex couples and same-sex couples alike. On that day, the People of California adopted Proposition 8, which amended the state constitution to eliminate the right of same-sex couples to marry. We consider whether that amendment violates the Fourteenth Amendment to the United States Constitution. We conclude that it does.

In short, in this brief, the United States government has put the force of a fully fleshed out legal argument behind Obama’s historic words during his Inaugural Address: “Our journey is not complete until our gay brothers and sisters are treated like anyone else under the law — for if we are truly created equal, then surely the love we commit to one another must be equal as well.”

The key to the brief is that it makes two arguments. The first is that it agrees with the ruling of a lower court — which found Prop 8 unconstitutional — that challenges to the constitutionality of such laws should require that they are subjected to “heightened scrutiny.” That means the court should hold their rationale for discriminating to an extremely high standard, and strike them down if they fail to have a credible justification.

The will of the people means a great deal to liberals.

But the people are subject to the rule of law, as are their elected representatives. Consequently, one’s civil liberties are not subject to majority rule, the majority doesn’t determine who will or will not have his rights.

was undecided about legalizing same-sex marriage when he ran for re-election to the Illinois Senate in 1998

and supported civil unions but not same-sex marriage when he ran for the U.S. Senate in 2004 and for U.S. President in 2008.

Obama voted against the Federal Marriage Amendment which would have defined marriage as between one man and one woman, but stated in a 2008 interview that he personally believes that marriage is "between a man and a woman" and that he is "not in favor of gay marriage."
He supports civil unions that would carry equal legal standing to that of marriage for same-sex couples, but believes that decisions about the title of marriage should be left to the states.


Now, Obama has called for the repeal of the federal Defense of Marriage Act (DOMA).

Flip flop or not...Obama has done more for the rights of gay Americans than any other Chief Executive before him. Fact.
