WASHINGTON (AP) -- President Barack Obama's advisers are finalizing a proposal that would expand background checks on gun sales without congressional approval.

White House adviser Valerie Jarrett says the president has asked his team to complete a proposal and submit it for his review "in short order." She says the recommendations will include measures to expand background checks.

We already have background checks that cover every state . How is expanding that existing law suddenly not Interstate commerce ?
The Federal Government can NOT force IN state sales to conform to Interstate sales. The Federal Government does NOT have the authority the power or the right to dictate to a State how it handles internal sales.

federally licensed dealers engage in interstate commerce

private sellers are not allowed to sell to anyone who resides outside the seller's own state INTRASTATE commerce does not create the jurisdictional nexus for the federal government to act. Obamatard isn't congress. He cannot make laws since only congress has such power.

The President does NOT have the power authority or right to create new law. Background checks are law he does not have the authority to change that law in any way.

What does the law say ? Most laws don't go into the minute details . They leave that to agencies . The agencies issue regulations . Those regs can be changed .

The Congress nor the President have authority or the power to regulate INTRASTATE commerce. It is illegal for a seller as a private citizen to sell a firearm to someone out of State without using at least 2 FFL dealers. One to ship it one to receive it.Background checks could be initiated on that sale. BUT the Government has no authority to initiate a background check with out a State law conducted solely in side the borders of a State.

Wrong as usual. Once a weapon is sold to an individual and they chose to sell it to another individual it is intrastate. Nice to know you think the Government can just ignore the Constitution though.
