I looked up who can pardon people for violation of DC laws. And it turns out that DC laws are federal. And only the president can pardon people for crimes that occur within Washington DC.

It took the Sec of the Army to give the O.K., but the Sec of the Army doesn't directly have that authority.

So there could have been a secondary fix to keep the national guard from coming to the rescue.
