The Unborn Victims of Violence Act of 2004 (Public Law 108-212) is a United States law that recognizes an embryo or fetus in utero as a legal victim, if they are injured or killed during the commission of any of over 60 listed federal crimes of violence. The law defines "child in utero" as "a member of the species Homo sapiens, at any stage of development, who is carried in the womb."

In 2021, a Bowie County, Texas grand jury on Friday returned a third indictment against a woman accused of murdering her pregnant friend and cutting an unborn baby from her friend’s body. The baby later died.

2023:A Missouri woman accused of kidnapping and murdering a pregnant Arkansas woman is facing new charges of killing the unborn baby who was ripped from its mother's womb.

Amber Waterman, 43, and her husband, Jamie Waterman, 43, were charged in a three-count superseding indictment returned by a federal grand jury in Springfield, Missouri, the U.S. Attorney for the Western District of Missouri announced Tuesday.



Marshae Jones, 27, of Birmingham, was indicted by a grand jury on a manslaughter charge and arrested Wednesday, the Alabama Media Group reports. The charges stem from a 2018 shooting in Pleasant Grove where Jones, then five months pregnant, was shot in the stomach near a Dollar General store. She had a miscarriage as a result, according to the Washington Post.

The alleged shooter Ebony Jemison, 23, was initially charged with manslaughter but a grand jury failed to indict her. Investigators say she acted in self-defense and that it was Jones who triggered the fight.

An Illinois woman pleaded guilty Monday to killing her pregnant friend, the unborn child and the victim's three children in a plea deal that allowed her to avoid the death penalty.

Tiffany Hall, 26, pleaded guilty to all five charges against her — four counts of murder and one of intentional homicide in the death of the fetus, which she cut from the mother's womb — and was sentenced to spend the rest of her life in prison without parole.
